This paper analyzes the rhetoric surrounding the profession’s presentations of auditor independence. We trace the evolution of thecharacter of the auditor from Professional Man in the early years of the twentieth century to the more public and abstract figures of Judicial Man and Economic Man. The changing character of the auditor in the profession’s narratives of legitimation reflects changes in the role of auditing, in the economic environment, and in the values of American society. Economic man is a self-interested and (...) shallow character who offered the auditing profession little protection against involvement in corporate scandals. In the wake of recent accounting scandals, the profession is calling for a return to the character of Professional Man to restore trust in audits and the financial markets.We also analyze the philosophical bases of the metaphors surrounding auditor independence. These metaphors, particularly the metaphor of independence as separation, create problems in conceptualizing independence concepts. How can you discuss appropriate relationships when your basic concept is one of separation, or no relationship? On the other hand, relational concepts of independence are also flawed if they are not based on a firm moral foundation. We suggest how the profession can act to rebuildits moral foundation through recognition of collective responsibility. (shrink)

Design thinking in general, and optimality modeling in particular, have traditionally been associated with adaptationism—a research agenda that gives pride of place to natural selection in shaping biological characters. Our goal is to evaluate the role of design thinking in non-evolutionary analyses. Specifically, we focus on research into abstract design principles that underpin the functional organization of extant organisms. Drawing on case studies from engineering-inspired approaches in biology we show how optimality analysis, and other design-related methods, play a specific methodological (...) role that is tangential to the study of adaptation. To account for the role of these reasoning strategies in contemporary biology, we therefore suggest a reevaluation of the connection between design thinking and adaptationism. (shrink)

The increasing application of network models to interpret biological systems raises a number of important methodological and epistemological questions. What novel insights can network analysis provide in biology? Are network approaches an extension of or in conflict with mechanistic research strategies? When and how can network and mechanistic approaches interact in productive ways? In this paper we address these questions by focusing on how biological networks are represented and analyzed in a diverse class of case studies. Our examples span from (...) the investigation of organizational properties of biological networks using tools from graph theory to the application of dynamical systems theory to understand the behavior of complex biological systems. We show how network approaches support and extend traditional mechanistic strategies but also offer novel strategies for dealing with biological complexity. (shrink)

Here I set the stage for developing a Kantian account of punishment attuned to social and economic injustice and to the need for prison reform. I argue that we cannot appreciate Kant's own discussion of punishment unless we read it in light of the theory of justice of which it is a part and the fundamental commitments of that theory to freedom, autonomy and equality. As important, we cannot properly evaluate Kant's advocacy of the law of retribution unless we recognize (...) his theory of justice as an ideal theory. Once we understand both Kant's larger account of justice and its relationship to his less basic commitments, we discover grounds to accept that larger theory, but reject components like the law of retribution with their basis in empirical conclusions we may not share with Kant. We also open the way to develop an account of punishment responsive to social circumstances. (shrink)

Despite the extreme violence and severe overcrowding that plague U.S. prisons, prison reform is nearly a non-issue in this country. Immanuel Kant's Metaphysics of Morals may first appear an unlikely place to seek support for a more critical view of prison conditions and popular attitudes toward them. But by appeal to the doctrines of right and virtue, we can discover substantial Kantian grounds to support reform efforts.On Kantian bases I thus develop two principles, the first a principle of justice and (...) the second one of civic virtue. Together these standards, intermediate between the more general principles of Kant's moral theory and our concrete practical problems, can guide us in addressing interrelated issues of prison conditions and crime deterrence and in evaluating our own tendency to view convicts as somehow outside the ranks of humanity. While the principles of improvement and of civic respect cannot provide final answers to relevant reform issues, they can carry us a significant distance in identifying and understanding our weight moral responsibilities in this realm. Obwohl die US-Gefängnisse mit starker Überfüllung und extremer Gewalt zu kämpfen haben, ist eine Reform des Gefängniswesens in den Vereinigten Staaten nahezu kein Thema. Kants "Metaphysik der Sitten" mag zunächst nicht als ein Ort erscheinen, an dem man für eine Kritik an den Bedingungen in den Gefängnissen und an der allgemeinen Einstellung in der Bevölkerung dazu irgendeine Hilfe sucht. Bei näherem Hinschauen können wir jedoch in Kants Rechts- und Tugendlehre wesentliche Gesichtspunkte entdecken, die die Reformversuche unterstützen. In meinem Beitrag entwickle ich auf Kantischer Grundlage zwei Prinzipien, ein Prinzip der Gerechtigkeit und ein Prinzip bürgerlicher Tugend, Standards, die irgendwo zwischen den allgemeinen Prinzipien von Kants Moraltheorie und unseren konkreten praktischen Problemen stehen. Zusammen können uns diese beiden Standards eine Anleitung dafür geben, wie die miteinander verwobenen Themen a) der Bedingungen in den Gefängnissen und b) der Verbrechensabschreckung anzugehen sind und wie wir unsere eigene Neigung zu beurteilen haben, verurteilte Strafgefangene als mehr oder weniger außerhalb der Menschheit stehend anzusehen. Obwohl das Prinzip der Besserung und das der bürgerlichen Achtung, wie ich sie nenne, auf die einschlägigen Reformprobleme keine endgültigen Antworten geben können, können sie uns doch bei der Erkenntnis und beim Verstehen unserer nicht geringen moralischen Verantwortung in diesem Bereich einen großen Schritt weiterbringen. To isolate, analyze and explain their most basic commitments, theories of justice typically idealize. They assume for theoretical purposes, for example, that human beings possess far greater knowledge than they do, or that society's members strictly comply with just laws. Yet because it falsifies, idealization undermines the practical applicability of an ideal theory's principles. ;Although ideal theories are unsatisfactory as they stand, their fundamental principles may be invaluable in addressing our problems of justice. From such basic principles we may derive (...) intermediate ones that bridge the gap between ideal world and real, and allow us to determine what ideal theory demands in actual circumstances. ;Going beyond others who recognize the need, but themselves offer only ideal theories, I develop a set of these intermediate principles. I examine Kant's theory of justice as a paradigm, and identify problems it cannot address because they have their source in non-ideal features, including limited knowledge, imperfect will and preexisting social injustice. I then appeal to a modified version of the perspective of the ideal citizen that Kant employs in the Rechtslehre. This modified perspective enables us to articulate principles that give effect to Kant's universal law of justice and categorical imperative in non-ideal circumstances. Illustrating its use in addressing issues such as prison reform and exclusionary zoning, I argue that augmented ideal theory can play a crucial role in our pursuit of social justice. (shrink)

Here Samuel Fleischacker undertakes an ambitious task. Primarily he aims to develop and defend an account of political liberty importantly distinct from the alternatives Isaiah Berlin made famous. Moreover, he promises to enunciate this account by appeal to Kant and Adam Smith and to demonstrate its practical strengths by comparison with the work of several contemporary political theorists, Rawls most significant among them.

This essay explores an increasingly popular genre of organized group travel in white mainline and emerging evangelical US Christianity I call “journeys to the margins”: trips centered on learning from marginalized persons for the traveler’s ethical formation. Drawing on ethnographic research with one case study, “Come and See Tours” to Israel/palestine, I interrogate how the commodified form of these trips shape possibilities for ethical subjectivation. First, I demonstrate ways in which journeys to the margins market ethical transformation to American Christian (...) consumers in the form of packaged moral narratives. Second, I focus on the paradoxical nature of journeys to the margins as simultaneously packaged commodities and ethical encounters. Finally, I use reformulations of freedom emerging from the anthropology of ethics to argue that possibilities for ethical subjectivation occur in moments when tour ideals come into tension with lived realities. Genome editing with engineered nucleases (GEENs) introduce site‐specific DNA double‐strand breaks (DSBs) and repairs DSBs via nonhomologous end‐joining (NHEJ) pathways that eventually create indels (insertions/deletions) in a genome. Whether the features of indels resulting from gene editing could be customized is asked. A review of the literature reveals how gene editing technologies via NHEJ pathways impact gene editing. The survey consolidates a body of literature that suggests that the type (insertion, deletion, and complex) and the approximate length of indel edits (...) can be somewhat customized with different GEENs and by manipulating the expression of key NHEJ genes. Structural data suggest that binding of GEENs to DNA may interfere with binding of key components of DNA repair complexes, favoring either classical‐ or alternative‐NHEJ. The hypotheses have some limitations, but if validated, will enable scientists to better control indel makeup, holding promise for basic science and clinical applications of gene editing. The final two essays center on law and religious freedom. John Burgess examines the privileging of religious freedom for canonizing martyrs in post-Soviet Russian Orthodoxy, arguing that this provides theological grounding for the legal right to religious freedom. Mary Ellen O'Connell proposes aesthetics as a more adequate modern grounding for legal authority than science. She argues that aesthetics takes us beyond the limits of self-interest, drawing us into concern for the good of others through the contemplation of beauty.What holds these essays together is the pursuit of "transdisciplinarity": "paying close attention to the other discipline(s) in a way that has a substantial and mutual impact, but at the same time retaining a clear sense of disciplinary integrity" (14–15). It is unsurprising, then, that both volumes respond to objections from the neo-Radical Reformation and Radical Orthodoxy camps. In his conclusion, Douglas Ottati argues that these camps cannot account for the ways in which theological production inevitably interacts with natural and cultural processes. He argues further that insulating Christian theology is a form of cultural accommodation because it mirrors the formation of discrete modern disciplines, the very limitation these essays seek to transcend.This volume advances the live discussion in Christian ethics about the promise and risks of engaging natural and social sciences. The provision of mental health services to women has come sharply into focus for providers of secure psychiatric services in the UK. Women's services are being developed in response to the known risks of mixed-sex provision, and a growing appreciation of the ways that women in secure services can be further disadvantaged by their minority status. Our intention here is to present evidence and reflections to help inform this development. The evidence is drawn from our recent work in this field, (...) which includes carrying out a review of local mental health services for ‘difficult’ women, and developing and piloting a national training programme for staff working with women in secure services. The reflections we offer are informed by the conviction that taking social inequalities into account is central to making sense of women's mental health difficulties, and improving service responses to women's needs. While there are signs that many mental health workers in secure services are beginning to share these convictions, the challenge now is to provide the necessary authorization, training and support that will enable them to translate these understandings into empowerment practice with women. There is a growing resurgence in the study of psychedelic medicines for the treatment of mental health and substance use disorders. However, certain early investigations are marred by questionable research methods, abuses against research participants, and covert Central Intelligence Agency financial involvement. The purpose of this study was to understand how and to what extent people of colour and other vulnerable populations, specifically, individuals who were incarcerated or incapacitated due to mental health issues, were exploited during the first wave of (...) psychedelic research in the USA. To do so, we reviewed available empirical publications according to current ethical standards. Variables of interest included race and ethnicity of participants, population vulnerability, drug administration conditions, informed consent and undue influence. Our findings draw attention to the history of research abuses against people of colour in Western psychedelic research. In light of these findings, we urge a call-to-action to current psychedelic researchers to prioritise culturally inclusive and socially responsible research methods in current and future studies. Biological evolution provides a creative fount of complex and subtle adaptations, often surprising the scientists who discover them. However, because evolution is an algorithmic process that transcends the substrate in which it occurs, evolution’s creativity is not limited to nature. Indeed, many researchers in the field of digital evolution have observed their evolving algorithms and organisms subverting their intentions, exposing unrecognized bugs in their code, producing unexpected adaptations, or exhibiting outcomes uncannily convergent with ones in nature. Such stories routinely reveal (...) creativity by evolution in these digital worlds, but they rarely fit into the standard scientific narrative. Instead they are often treated as mere obstacles to be overcome, rather than results that warrant study in their own right. The stories themselves are traded among researchers through oral tradition, but that mode of information transmission is inefficient and prone to error and outright loss. Moreover, the fact that these stories tend to be shared only among practitioners means that many natural scientists do not realize how interesting and lifelike digital organisms are and how natural their evolution can be. To our knowledge, no collection of such anecdotes has been published before. This paper is the crowd-sourced product of researchers in the fields of artificial life and evolutionary computation who have provided first-hand accounts of such cases. It thus serves as a written, fact-checked collection of scientifically important and even entertaining stories. In doing so we also present here substantial evidence that the existence and importance of evolutionary surprises extends beyond the natural world, and may indeed be a universal property of all complex evolving systems. It is a matter of fact that Europe is facing more and more crucial challenges regarding health and social care due to the demographic change and the current economic context. The recent COVID-19 pandemic has stressed this situation even further, thus highlighting the need for taking action. Active and Assisted Living technologies come as a viable approach to help facing these challenges, thanks to the high potential they have in enabling remote care and support. Broadly speaking, AAL can be referred (...) to as the use of innovative and advanced Information and Communication Technologies to create supportive, inclusive and empowering applications and environments that enable older, impaired or frail people to live independently and stay active longer in society. AAL capitalizes on the growing pervasiveness and effectiveness of sensing and computing facilities to supply the persons in need with smart assistance, by responding to their necessities of autonomy, independence, comfort, security and safety. The application scenarios addressed by AAL are complex, due to the inherent heterogeneity of the end-user population, their living arrangements, and their physical conditions or impairment. Despite aiming at diverse goals, AAL systems should share some common characteristics. They are designed to provide support in daily life in an invisible, unobtrusive and user-friendly manner. Moreover, they are conceived to be intelligent, to be able to learn and adapt to the requirements and requests of the assisted people, and to synchronise with their specific needs. Nevertheless, to ensure the uptake of AAL in society, potential users must be willing to use AAL applications and to integrate them in their daily environments and lives. In this respect, video- and audio-based AAL applications have several advantages, in terms of unobtrusiveness and information richness. Indeed, cameras and microphones are far less obtrusive with respect to the hindrance other wearable sensors may cause to one’s activities. In addition, a single camera placed in a room can record most of the activities performed in the room, thus replacing many other non-visual sensors. Currently, video-based applications are effective in recognising and monitoring the activities, the movements, and the overall conditions of the assisted individuals as well as to assess their vital parameters. Similarly, audio sensors have the potential to become one of the most important modalities for interaction with AAL systems, as they can have a large range of sensing, do not require physical presence at a particular location and are physically intangible. Moreover, relevant information about individuals’ activities and health status can derive from processing audio signals. Nevertheless, as the other side of the coin, cameras and microphones are often perceived as the most intrusive technologies from the viewpoint of the privacy of the monitored individuals. This is due to the richness of the information these technologies convey and the intimate setting where they may be deployed. Solutions able to ensure privacy preservation by context and by design, as well as to ensure high legal and ethical standards are in high demand. After the review of the current state of play and the discussion in GoodBrother, we may claim that the first solutions in this direction are starting to appear in the literature. A multidisciplinary debate among experts and stakeholders is paving the way towards AAL ensuring ergonomics, usability, acceptance and privacy preservation. The DIANA, PAAL, and VisuAAL projects are examples of this fresh approach. This report provides the reader with a review of the most recent advances in audio- and video-based monitoring technologies for AAL. It has been drafted as a collective effort of WG3 to supply an introduction to AAL, its evolution over time and its main functional and technological underpinnings. In this respect, the report contributes to the field with the outline of a new generation of ethical-aware AAL technologies and a proposal for a novel comprehensive taxonomy of AAL systems and applications. Moreover, the report allows non-technical readers to gather an overview of the main components of an AAL system and how these function and interact with the end-users. The report illustrates the state of the art of the most successful AAL applications and functions based on audio and video data, namely lifelogging and self-monitoring, remote monitoring of vital signs, emotional state recognition, food intake monitoring, activity and behaviour recognition, activity and personal assistance, gesture recognition, fall detection and prevention, mobility assessment and frailty recognition, and cognitive and motor rehabilitation. For these application scenarios, the report illustrates the state of play in terms of scientific advances, available products and research project. The open challenges are also highlighted. The report ends with an overview of the challenges, the hindrances and the opportunities posed by the uptake in real world settings of AAL technologies. In this respect, the report illustrates the current procedural and technological approaches to cope with acceptability, usability and trust in the AAL technology, by surveying strategies and approaches to co-design, to privacy preservation in video and audio data, to transparency and explainability in data processing, and to data transmission and communication. User acceptance and ethical considerations are also debated. Finally, the potentials coming from the silver economy are overviewed. (shrink)

Pp. viii + 398.As early as Bhāvaviveka (sixth century), Indian Buddhist doxographers situated important philosophers in schools and sub-schools characterized by adherence to distinct views, thereby providing a coherent, hierarchical presentation of the Buddha's teaching. In Tibet this practice continued and gained considerable importance: the pedagogical and hermeneutical significance of ordering texts occasioned widespread doxographical literary production.1 The doxographical projects, in which the systematic understanding of unchanging 'tenets' was privileged over the singular views of individual authors, were highly contested. Much of the disagreement was due to the multiplicity of interpretations bound to arise during a millennium of intellectual exchange. Doxographical hierarchy set the parameters of intellectual discourse, and thus the classification of tenets was not simply a matter of historical interest. Traditions were constructed in such a way that one's own thought would conform to an acceptable view, to say nothing of the complex relationship between political power and religious doctrine in Tibet. Despite the contested status of Tibetan doxographical categories, the classifications and distinctions that order much contemporary Western scholarship on Mahāyāna Buddhism in India were inherited from Tibet. The original locus of the discussion is three Indian commentaries on Nāgārjuna's (second century) Mūlamadhyamakakārikā. Buddhapālita (fifth-sixth centuries), in what is the oldest extant commentary on the Mūlamadhyamakakārikā by a known author, followed Nāgārjuna's reductio ad absurdam form of argumentation, leading from the opponent's premise to an untenable consequence (prasaṅga, thal 'gyur). Shortly thereafter Bhāvaviveka claimed that for every prasan.ga argument in Nāgārjuna's text there is an unstated positive argument, and he criticized Buddhapālita for not utilizing the new methods of Buddhist logic to demonstrate the validity of Madhyamaka thought. Bhāvaviveka argued that Mādhyamikas ought to present formal probative (prayoga; sbyor ba) and autonomous (svatantraprayoga; rang rgyud kyi sbyor ba) arguments and argued that inferential reasoning was necessary to establish the Madhyamaka view of emptiness. Candrakīrti (seventh century) then defended Buddhapālita, insisting that prasaṅga arguments were the only fitting method for a Mādhyamika because they do not require the affirmation of inherent nature. Roughly five centuries later, although Madhyamaka had already been divided according to a variety of classifications in India and Tibet, some Tibetan scholars retroactively characterized Bhāvaviveka as the founder of the Svātantrikas and Candrakīrti as the [End Page 415] founder of the Prāsaṅgikas. Tsong kha pa (1357-1419), the most famous proponent of the Svātantrika-Prāsaṅgika distinction, believed this debate was about more than methodological or epistemological questions: because autonomous argumentation requires inherently existing objects, even if only conventionally, he claimed that Svātantrikas were crypto-realists who deviated from Nāgārjuna's radical understanding of emptiness.Tsong kha pa's analysis of the Svātantrika-Prāsaṅgika distinction, and therefore Madhyamaka philosophy in general, came to dominate Western scholarly research. However, in the last few decades there has been considerable exploration of the forces and influences that contributed to the emergence of conflicting Tibetan doxographical systems.2 This research program has been significantly furthered with the publication of The Svātantrika-Prāsaṅgika Distinction: What Difference Does a Difference Make? Many philosophers hypothesize that our concept of personal identity is partly constituted by the one-person-one-place rule, which states that a person can only be in one place at a time. This hypothesis has been assumed by the most influential contemporary work on personal identity. In this paper, we report a series of studies testing whether the hypothesis is true. In these studies, people consistently judged that the same person existed in two different places at the same time. This result undermines (...) some widely held philosophical assumptions, supports others, and fits well with recent discoveries on identity judgments about inanimate objects and non-human animals. In this essay I identify a type of linguistic phenomenon new to feminist philosophy of language: biased evaluative descriptions. Biased evaluative descriptions are descriptions whose well-intended positive surface meanings are inflected with implicitly biased content. Biased evaluative descriptions are characterized by three main features: (1) they have roots in implicit bias or benevolent sexism, (2) their application is counterfactually unstable across dominant and subordinate social groups, and (3) they encode stereotypes. After giving several different kinds of examples of biased evaluative (...) descriptions, I distinguish them from similar linguistic concepts, including backhanded compliments, slurs, insults, epithets, pejoratives, and dog whistles. I suggest that the traditional framework of Gricean implicature cannot account for biased evaluative descriptions. I discuss some challenges to the distinctiveness and evaluability of biased evaluative descriptions, including intersectional social identities. I conclude by discussing their social significance and moral status. Identifying biased evaluative descriptions is important for a variety of social contexts, from the very general and broad (political speeches) to the very particular and small (bias in academic hiring).
